4Winners Merch Terms and Conditions

Our terms and conditions cover all aspects of our business operations, including printing, web design, consulting, marketing, and fulfillment services. By subscribing to our services or placing an order, you agree to these terms, acknowledging that they apply to all transactions with 4Winners Sports Group LLC ("4Winners").

Terms and Conditions

1. Client Responsibilities and Communication

  • Client Communication Requirement: To ensure accurate and timely production, all clients are required to maintain open and responsive communication throughout the entire process. Clients must promptly review and approve quotes, invoices, proofs, and artwork. Delays in communication may result in production or delivery delays for which 4Winners will not be held responsible.

  • Approval of Proofs & Quotes: All sizes, quantities, products, colors, and designs must be reviewed and approved by the client. Once approved, clients assume full responsibility for any errors or omissions in the approved materials. No changes or cancellations can be made after approval unless agreed to in writing by 4Winners.

2. Payment Terms and Late Fees

  • Payment Terms: Payment is due in full before production begins unless you have been granted Net30 terms as a Platinum or Diamond customer. Payment must be received on or before the due date specified on the invoice.

  • Late Payments: Failure to make full payment by the due date will result in a late payment charge equal to 15% of the total order value, as well as a daily late fee of $25. Late payments may also delay production and delivery. Clients with repeated late payments may lose any extended payment terms (Net30).

3. Refund and Return Policy

  • Refund Eligibility: If you are not 100% satisfied with your purchase, you may request a return or exchange within 14 days of receiving your order. After this 14-day period, your order is no longer eligible for refund or exchange. All returned or exchanged products must be in the condition in which they were received. Some customized products may not be eligible for a refund, particularly customer-owned items.

  • Customer-Owned Products: We are not liable for any issues with customer-owned products submitted for customization. Clients assume full risk and responsibility for these items. 4Winners will not replace or refund services provided on these items.

4. Order Cancellations and Changes

  • Once an order has been approved and payment received, it cannot be canceled, altered, or refunded. This includes all forms of services, including but not limited to print orders, digital design services, consulting engagements, and marketing efforts.

  • Any changes requested after approval are subject to additional fees and extended lead times, subject to 4Winners’ discretion.

5. Prepress Materials and Intellectual Property

  • Ownership of Prepress Materials: All prepress materials (including screens, artwork, embroidery files, films, and any associated digital or physical assets created by 4Winners) remain the sole property of 4Winners. Clients may not request or claim ownership of these materials​​.

  • Client Intellectual Property: Any designs, logos, or artwork provided by the client for use in production must not infringe upon any third-party intellectual property rights. The client assumes full responsibility for securing rights and permissions for all materials they provide. 4Winners reserves the right to refuse any work that it believes may violate intellectual property laws​.

6. Shipping and Delivery

  • Shipping Fees and Tracking: Shipping fees are calculated based on the weight of the product and the destination. Tracking numbers will be provided upon shipment. 4Winners is not responsible for delivery delays caused by the shipping carrier. Clients with orders exceeding $10,000 must provide a signature upon delivery​.

  • Damaged or Lost Shipments: For packages lost or damaged in transit, claims must be submitted within 14 days of the estimated delivery date. In the event of lost or damaged goods, 4Winners will either replace the product or offer a refund at its sole discretion​.

  • Delivery Timelines: Orders are typically shipped within 14 business days from production approval. Non-established print-on-demand products, such as new designs, may require longer lead times​.

7. Scope of Services

  • Web Development & Digital Marketing: Any web development or digital marketing services are provided as outlined in the approved proposal or contract. These services are subject to the same approval, payment, and communication requirements as other services. Custom software solutions, web management, and API integrations will incur additional fees based on scope​​.

  • Consulting & Design Services: Consulting and creative services are billed based on the agreement made during contract signing. Clients are responsible for providing timely feedback and approvals throughout the consulting or design process. Failure to respond or provide necessary information may delay the project without liability on the part of 4Winners​.

8. Customer Satisfaction and Complaint Handling

  • Misprinted or Defective Items: If your order contains any defects or misprints, please notify 4Winners within 14 days of receiving the product. Claims made after this period may not be eligible for replacement or refund. Clients are required to submit photos of any defective items for verification​.

  • Order Disputes: Any disputes or issues related to your order must be communicated to 4Winners within 30 days of delivery. Disputes raised after this period will not be addressed​.

9. Liability and Indemnification

  • Limited Liability: 4Winners will not be held liable for any indirect, incidental, or consequential damages, including but not limited to lost profits, business interruption, or loss of data, arising from the use of our services. Our total liability is limited to the amount paid for the service or product that caused the claim​.

  • Indemnification: Clients agree to indemnify and hold 4Winners harmless against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from any breach of these terms by the client, including but not limited to violations of intellectual property rights or customer disputes​.

10. Modifications to Terms

  • 4Winners reserves the right to update and modify these terms and conditions at any time without prior notice. Clients are encouraged to review the terms regularly to stay informed of any changes. Continued use of our services after changes to the terms constitutes acceptance of the modified terms.

11. Termination of Services

  • Client-Initiated Termination: Clients may cancel their services with 4Winners at any time, but no refund will be issued for any payments already made. Any outstanding payments for services rendered must still be paid in full.

  • 4Winners-Initiated Termination: 4Winners reserves the right to cancel contracts at any time if the client fails to meet performance expectations or violates any terms. No refunds will be issued in cases of termination due to client violation​.

12. Force Majeure

4Winners will not be held liable for delays or failure to perform any obligations under these terms if the delay or failure results from any cause beyond reasonable control, including but not limited to acts of God, war, terrorism, labor strikes, embargoes, natural disasters, or pandemics.
